Subdivision Review & Revision

Subdivision review is generally required when a lot is split into three or more lots. Please refer to Section 1-2 of Eliot's Town ordinances as well as applicable State statutes for more detail on how a subdivision is defined in the State of Maine. Section 41 of the Town's ordinances outlines the process and requirements for Subdivision Review. Chapter 37 outlines the requirements for the Town's Street and Sidewalk Standards. However, other sections of the Town's ordinances will also apply and must be considered throughout the planning process. 

Steps to Submit a Subdivision Review Application: 

  1. Discuss the project with the Town Planner to obtain ordinance requirements. You may schedule a meeting by emailing or calling the Town Planner. 
  2. The Town Planner will provide requirements applicable to the proposed project using the Subdivision Review Checklist, to clearly outline the ordinance standards. It should be used as a guide for the application process. Please keep in mind that the Planning Board may request additional information relating to review of the application to determine how the application complies with the Town's ordinance standards. 
  3. Submit all materials as indicated on the checklist on or before the Submission Deadline and pay the applicable fee for Subdivision Review, which is listed in Section 1-25 of the ordinances. The Planning Board reviews applications on the second meeting of the month. The first meeting of the month is designated for administrative matters and workshop discussions. 
  4. The Planner will complete a preliminary review of the application, and will send the completed application to other staff and Boards for their review, as outlined in Section 41 of the Town's ordinances. The applicant will receive notification of the agenda and review memo in advance of the meeting. 
  5. Please consult Section 41 of the Town's ordinances for more detail about ordinance requirements for proposed subdivisions. 
  6. The applicant should attend every meeting at which the application is listed on the agenda. 

Information about Subdivision Revisions: Once the Planning Board has approved a Subdivision application, the land must be divided in compliance with that approved plan. Any proposed revision to the Planning Board's originally approved subdivision plan must be re-submitted to the Planning Board for review, per Section 41-182 of the Town's ordinances. Revisions include property swaps and property transfers that will alter the originally approved plan. To begin the process of a revision to an originally approved subdivision plan, please first contact the Town Planner to discuss the proposed revision(s) to the originally approved subdivision. The application form to use to request a revision to an approved subdivision plan is the Request for Planning Board Action application. The fee is found in Section 1-25 of the Town's ordinances. Applications must be submitted in accordance with the Submission Deadlines

Helpful Links and Ordinance Standards to Use When Planning Your Proposed Application: 

  • You can use the Town's Assessor Database to search for the map and lot number for the address where you are planning the subdivision. 
  • You can also use the Town's GIS system to generate a scaled plan, look up zoning districts and other applicable layers, for a preliminary review of the land area. 
  • Section 45-405: Dimensional Standards - Each new lot must conform to the applicable dimensional standards for the zone. (For open space development, please refer to Section 45-467 of the Town's ordinances). 
  • Section 41: This section of the ordinances contains Subdivision standards. 
  • Section 44: This section of the ordinances contains the Shoreland Zoning standards, which are applicable if the property is located in any of the shoreland zones. 
  • Section 35: If the proposed project will disturb more than one acre of land, provisions of the Town's Post Construction Stormwater Management Ordinance will apply.
