Where Can I Find Information About the Town's Nonconformance Standards?

There are several types of nonconforming situations discussed in the Town's ordinances. The following information is intended only to provide a brief overview of some of the standards. However, questions of nonconformance should be directed to either the Town Planner or Code Enforcement Officer

Nonconforming Structures: Structures that do not meet the required Dimensional Standards for the zone, but are allowed to remain in place because the structure was in legal existence before the ordinance standard(s) took effect or was revised (Section 1-2). Sections 45-191 to 45-195 provides the Town's ordinance standards on nonconformance within general zoning. Section 44-32 discusses nonconforming structures, relative to relocation, reconstruction and expansion in Shoreland Zones. 

Nonconforming Lots: A single lot which does not meet the Dimensional Standards for the zone but was in effect before the adoption or applicable revision of the ordinance (Section 1-2). The Town's ordinance standards on nonconforming lots are found in Sections 45-194 and for nonconforming lots in Shoreland Zones, in Section 44-32

Nonconforming Uses: A use "which is not permitted in the district in which it is situated, but which is allowed to remain solely because it was in lawful existence" at the time the ordinance or ordinance revisions took effect (Section 1-2). The Town's ordinance standards on nonconforming uses are found in Sections 45-191 to 45-195. In general, a nonconforming use may only continue under specific ordinance standards as specified in these sections.
